The Merriam-Webster free dictionary defines “personal injury” as “an injury affecting one’s physical and mental person as contrasted with one causing damage to one’s property”. As such, there are a wide variety of types of personal injury cases. Some law firms even specialize in these specific topics.

Road Traffic Accidents And Assault Claims

Among the most common cases falling under the jurisdiction of personal injury lawyers are road traffic accidents and assault claims. Occasionally these two categories can cross over to each other, when it becomes unclear whether a traffic accident was caused intentionally or not. Despite the nature of personal injury cases, a traffic case will typically end in compensation for the damaged car. Any physical injury will significantly raise the compensation. Assault claims are usually more based on emotional distress, which was only recently implemented as a legal claim.

Other Accidents

Less common but still prevalent cases include tripping accidents, product liability, accidents in the house, and defamation cases. Tripping includes literally everything to do with accidentally falling – if a public project caused a sidewalk to crack and someone tripped, causing physical harm, a lawsuit could be filed against the origin of the public project. Product liability is just as it sounds – producers of items are liable for any and all damages caused. It can be tricky sometimes to determine emotional distress claims in cases of product liability. Accidents in the house primarily relate to injuries in other peoples’ homes. Finally, public defamation cases come as a result of slander or libel. It is important to note that defamation, slander or libel can only be claimed if the publicized statement is state as a fact and is false – negative statements that are true or opinions cannot be raised to court.

Work Related Cases

Personal injury lawsuits relating to work are quite common in popular culture, and almost as common in the actual courts. Being “hurt on the job”, or falling victim to a workplace accident, is grounds for what many lawyers consider an easy lawsuit. This is because employers are responsible for the safety of their employees. Harassment charges are another type of personal injury that often occurs at work, generally falling under emotional distress, pain and suffering, or loss of consortium claims. Less common as time goes on are cases of industrial disease. Exposure to substances like asbestos cause serious health issues, and a number of older buildings have asbestos-based products for insulation. Other occupational lawsuits may be filed for stress, carpal tunnel (or any repetitive strain injury), asthma, deafness, and anything else that negatively impacts a person as a result of their work.
There are many types of cases and claims for personal injury lawsuits. Sometimes, a case may be as simple as identifying the source of a physical injury. Other times, the damages are not so clear and refer more to a person’s psychological well-being. These claims can prove to be highly emotional and are not for the weak-willed.
