A too typical story of a man battling for benefits in the face of VA liars who judged in terms of honor and duty can not hold a candle to the men and women whom they are pledged to serve.
By Chauncey L. Robinson
I enlisted into the United States Military on January 7, 1992 and graduated basic training sometime around early March of 1992!
In March of 1992 I sustained an eye injury that needed surgery in April of 1992 because I accidentally was kicked in the left eye causing a left orbital fracture to the left eye socket, I had chest x-rays taken before the surgery and my heart was normal. The eye surgery was to be performed by Captain Susan Parks at General Leonard Wood Hospital at Fort Leonard Wood Mo. where I was stationed! After the surgery Captain Parks issued me medical profile letter permitting to command quarters desk duty to answer telephones only.
On May 3, 1992 the drill sergeant Michael Beulher on duty that night sent three different soldiers to my bunk to wake me up for “(KP) Kitchen Privileges duty” and I showed each and every one of them my medical letter from Captain Susan Parks, so he decided to take it upon himself and come to my bunk and turn it over with me in it to wake me up and force me to (KP) duty. I fell out my bunk and hit my head on the wall locker, I was laying on the floor and he began screaming at me to go to (KP) duty, I went and the (KP) sergeant on duty that night sent me back to the barracks with instructions to sergeant Michael Beulher to never send an injured soldier to his kitchen again. I experience chest pains and was sent to the clinic and my blood pressure was taken and found to be very high, so they sent me to General Leonard Wood Hospital for chest x-rays and it was then discovered my heart enlarged! I requested why my chest x-ray had changed from normal to be enlarged and all of a sudden I was mistreated and finally given honorable discharge on July 7, 1992.
I came home and submitted my claim for VA compensation benefits at the VA Regional Office in New York City around July of 1992. I had a hearing in 1993 and it was denied, I appealed. Sometime around 1995 I submitted a claim for (SSI) and was sent the (SSI) doctor for an examination, the (SSI) doctor Robin Tassinari diagnosed with “P.T.S.D. and Cardiovascular Disease and Hypertension.” I submitted the medical findings of Dr. Robin Tassinari to the VA Regional Office in New York City, only to learn that my original claim file was either lost or destroyed around 1995. In 1995 I filed a claim for (P.T.S.D.) and it was denied, so I requested an appeal to the Board of Veterans Appeals and they granted the (P.T.S.D.) but denied the Cardiovascular Disease and Hypertension in 1999; and I appealed the Cardiovascular Disease and Hypertension the same year. On November 19, 2003 I had a hearing at the VA Regional Office in New York City and it was again denied. On December 10, 2003 “I requested my claim to be sent to the Board of Veterans Appeals, based on the fact that I have given all the medical evidence to prove legitimacy of my claim for Cardiovascular Disease and Hypertension.” On July 30, 2004 “my appeal was received at the Board of Veterans Appeals and was returned the docket. On September 3, 2004 “the Board of Veterans Appeals denied my appeal for Cardiovascular Disease and Hypertension and I requested my appeal be sent to the United States Court of Appeals for Veterans Claims.
On September 4, 2004 “my attorney submitted a motion to remand my appeal back to the Board of Veterans Appeals due to the fact that the Secretary of VA, VA Regional Office and Board of Veterans Appeals handled the process of retrieving my original claim file wrongfully and the motion to Vacate and remand was granted with a court order that the Board of Veterans Appeals and VA Regional Office in New York City locate my original claim file! On November 13, 2008 a chief administrator named Joseph Collorafi was caught up in a paper shredding/falsifying the VA database to make it appear they were ahead of schedule in processing veterans claims, Joseph Collorafi handled my claim at the VA Regional Office in New York City.
On January 21, 2010 and January 29, 2010 I had a Compensation and Pension Examination by a doctor Jeffery Fisher who was some what blind, understand one thing I don’t like writing this about a person with any physical problem at all, Dr. Fisher order a “Luke Stress Test for me on January 29, 2010; during the test I started experiencing severe chest pain and I instructed both doctors but they said I needed to finish and put their hands in my back to hold me on the treadmill to finish the test for whatever reasons I don’t understand because I’ve had plenty of those tests done and whenever I experienced chest pains the test ended for safety reasons! On March 5, 2010 “my claim for Cardiovascular Disease and Hypertension secondary to service connected P.T.S.D. was changed and granted Hypertensive Cardiovascular Disease with chest pain syndrome secondary to service connected P.T.S.D. with a rating of (10%)! An act of rating scheme for the purposes of denying United Veterans of America proper payment in order save money. I was suppose to receive a program called “Special Monthly Compensation according to my Congressman’s staffer who said the VA Congressional Liaison told her the VA Regional Office in New York said they would deny me that program.” Yet they did! So my attorney is appealing for a rating increase!
P.S. It is a fact that I want my just due as related to compensation but I am determined to get the story out there concerning the truth about the VA back log, it is my ultimate goal to expose the truth this back log the higher up within the VA system is not just about lack of employees, it more truth to the fact of corruption and a lack of compassion by VA employees!!!!!!!
